UPDATE: U.S. Supreme Court won’t take up Texas challenge to Wisconsin and three other states’ conduct of the presidential election. No standing. As we predicted. Wisconsin high court to consider Donald Trump’s state lawsuit. Court after court in state after state has ruled no foul. Same with Republicans who run Georgia. Six of nine justices on the U.S. Supreme court appointed by Republicans; three by Donald Trump. We Lost. Get Over It! Even if WI supremes rule for Trump, our 10 electoral votes won’t change the outcome.

I went over the rather glaring factual and legal problems with the [Texas lawsuit v. Wisconsin and three other states] in my newsletter Wednesday. [To] sum up the basic deficiencies:

  • Texas doesn’t have standing,
  • Texas’s factual claims are almost laughably incoherent,
  • its legal claims have been repeatedly rejected by previous courts, and
  • there is no legal foundation for the remedy they seek.

The president, of course, endorsed it immediately.

The NY Times, for instance, did NOT report stolen votes in Georgia and Pennsylvania! But Trump bitter-enders believe what they want to believe. BTW: there’s a reason you can’t read the text.  David French continues:

And now 17 state attorneys general and 106 Republican members of Congress have filed amicus briefs in support of Texas’s frivolous case. This is dangerous, irresponsible behavior. Most (but not all) of the signatories know the case has no chance. They also know that by filing an amicus brief, they’re communicating exactly the opposite message to their constituents.

Many of them also know that if the Supreme Court did rule in their favor, it would likely break this country. In fact, many of their own states (including Texas) made election changes to accommodate the pandemic that would be unlawful under the logic of their argument. Similar lawsuits would gut the entire election, generate massive chaos, and surely lead to political violence and calls for separation and secession.

Making a lawless Supreme Court argument in the effort to create such a crisis is one of the most breathtakingly irresponsible (and outright malicious) public acts I’ve ever seen in my life.

    AT base, French is merely stating his own personal bias as a closet Democrat. Examine his case carefully–it is tautological.

    IF the Supreme Court does NOT take the case, the outcome will —> be the same as if you (French) postulate, namely:

    Now, sir, let’s all remember Mr. David French is hardly an unbiased observer, he does have a lot of emotional investment in his NeverTrump point of view, as does National Review. In fact, it’s hard to tell the difference between them and the Washington Post anymore.

    People keep writing this, and it’s basically an example of failed reasoning. Because the US Supreme Court has accepted the case, therefore USSC disagrees. Perhaps French should scoot on over to SCOTUS and explain to Justice Thomas how he doesn’t know what he’s doing, and David French will set him right?

    It is dumb. Anyone who writes “Texas doesn’t have standing” after USSC recognized standing is too dumb to be opining in public, and should be too embarrassed to show their face for a long time.

    Well, I’ve found David French’s articles to be laughably incoherent for years, so on behalf of Texas I declare “evenses”. However, once again, SCOTUS disagrees, because they took the case. One can disagree with the argument, of course, but point-and-laugh isn’t a legal argument. I’d expect better from David French, but apparently he’s blinded by his NeverTrump hate.

    Non sequitur. If David French could ever get around to reading the Constitution he would know why Texas filed with SCOTUS as a “court of first resort”.

    HINT: Article III Section 2 of the US Constitution.

    This is also an intelligence test, and French has failed it. He’s got a lot of company, but even if a million people say that red is really green, or some other falsehood is true, it is still….false.

    “Legal remedy” is whatever a majority of the SCOTUS says. Has been for decades. _Roe_ and _Doe_ for example, _Obergefell_ for a more recent example. David French is surely well enough informed to know this objection is moot, he’s just having an emotional moment of pounding the table.

    However Article II of the Constitution spells out a remedy in the means of selecting electors.

    More people should read actual source documents, like the Constitution.

    One little sample:

    Michigan also admits that it “is at a loss to explain the[] allegations” showing that Wayne County lists 174,384 absentee ballots that do not tie to a registered voter. Mich. Br. 15; Compl. ¶ 97.

    174,384 mystery ballots from unknown persons in one county is a lot. This obvious fraud is one major reason two county officials initially refused to certify the vote. There is evidence they were then intimidated with threats to change their vote, but that’s not the issue.

    174,384 votes in one county that cannot be tied to a register voter is prima face evidence of fraudulent voting. If the US is heading for a Constitutional crisis, there’s plenty of blame to heap on the DNC for their criminal behavior in pursuit of power.

      Reread your own post please? Read it carefully. MI did not admit that there were 174k fraud votes. They said: “Michigan also admits that it is at a loss to explain the allegations…”

      In other words, MI doesn’t understand what TX is ALLEGING.

      If you have any actual prima facie evidence to back up your assertion — let’s see it? Like most people on this site, I’m an evidence kinda-guy. Numbers _are_ persuasive.

    WOSW! I never had any idea most the posters here are from some way-out-there fringe of Trump supporting morons and syncopates. Yes, Paxton suits did make the claim that there were 174000+ unregistered ballots, but nothing, zero, zilch, supports this claim, like each and every claim as to election fraud has been proven false. Obviously the republicans in charge think they’re dealing with a bunch of clueless idiots they’re used to dealing with at rallies and appearances. Thank god for the judicial check of power as the congressional check has failed to do their job.

    SCOTUS could adjudicate the alleged violations of state law. Rather than dividing America even more, they could remove all doubt, Biden could become more legitimate and our faith and trust in both our electoral system and our government could be restored. It could diffuse the threat of another Civil War, Seccession and more BLMing. (burning, looting, murdering).

      Have you ever asked yourself why these different wings of the GOP hate Trump with such a passion?

      My take: The wealthy NTs hate Trump because he exposes the deep swamp and their corruption. The working class NTs hate Trump because he has changed the dynamics of the Republican party. It’s more diverse & inclusive (welcoming to LGBT, for example), and that threatens the status quo, which is intimidating to them.

    Millions of Americans have seen and read the testimonies and sworn affidavits (they’re ALL lying??) the data dumps, missing USB drives, statistic improbabilities, more ballots than actual people, reams of duplicate ballots, and most tellingly that when Trump was easily winning on election night, counting abruptly stops, and when it picks up ballots are found that benefit Biden?

    And you’re asking us to just get over it? No, thanks.

    Will we act like the unhinged on the left and stomp our feet and act like terrorists because we didn’t get our way? No, but that doesn’t mean we accept that this election was legitimate.

    An even more pressing issue that I’d think any patriot would be concerned about (even never-Trumpers), is the future integrity of elections. If people believe their ballot won’t mean anything, they won’t vote. And when this happens, we have a crisis.

    I try to listen to many different perspectives. Part of this is regularly reading this blog and comments. And for years now I’ve read here time and time again about how people on the left are “idiots” and “not fact based” and “constantly react to adversity with a victim mentality”. And I must say, many times I think these observations are correct.
    But now, we’re expected to believe that these ‘idiots’ have pulled off the biggest conspiracy in the history of mankind without leaving any evidence?
    And despite losing virtually every court decision, despite not being able to find one scintilla of proven evidence, despite Trump’s own people saying there was no fraud and that this was the most secure election in our history, despite all objective, provable, dare I say ‘fact based’ truth showing this election to be without widespread fraud; despite all of that, there are still so many in the Republican party that still believe (or at least promote) this nonsense. And they do it for only one reason. Because Trump said so.
    It is breathtaking that so many of the ‘fact based’, ‘reasonable’, ‘intelligent’ people, when faced with a result they don’t like, turn into the exact same type of entitled, whiny, fact less victims they have held in such disdain over the past 4 years.
    That my friend, is the true Trump Derangement Syndrome.
    It would be funny if it weren’t so damaging to the country we all love.
