Contrary to Nancy Pelosi’s dictum that criminal defendants must prove their innocence, our legal system requires the state to prove guilt. But the might of the state is arrayed against defendants who either pay for their own defense or trust their fate to a court-appointed attorney.
As a practical matter, there are certain crimes for which you do not want to be accused, no matter how innocent, depending on the zeitgeist of the times. Remember the hysteria around “ritual satanic child abuse” in the 1980s? Its most notorious efflorescence resulted in “bizarre and physically impossible” charges against the McMartin preschool that were ultimately dropped years later.

In the wake of George Floyd, Jacob Blake, Michael Brown et al, you do not want to be a police officer accused of shooting a black man regardless of culpability. Especially in Dane County. Which is where Mark Wagner is at. Mr. Wagner was a state criminal investigator, a veteran of 30 years in law enforcement, when, on 02-03-22 he and other officers attempted the arrest of one Quadren Wilson, an alleged fentanyl dealer with a lengthy police record.
Wagner, age 50, fired into Wilson’s vehicle, injuring the suspect who, apparently, was unarmed. Seven months later, Dane County District Attorney Ismael Ozanne filed a charge of second-degree recklessly endangering safety with use of a dangerous weapon. Wagner is the only one charged. As for Wilson, he pled guilty in May 2022 to delivering narcotics resulting in a fatal overdose. He was sentenced to 3 years in prison and 3 more years of supervision.
Blaska’s Bottom Line: The Werkes does not presume to judge guilt or innocence. Law enforcement should be held to a higher standard. We also recognize the life-or-death decisions law enforcement must make in an instant and the leisure in which those decisions can be second-guessed. Nor can we ignore social and political pressures that accompany an inter-racial police shooting.
We thought it significant that an organization exists to defend police officers accused of crime, the Law Enforcement Legal Defense Fund. Especially given the murder of two small-town police officers after a traffic stop Saturday 04-08-23 in northwestern Wisconsin. They were Emily Breidenbach, 32, of the Chetek police department and Hunter Scheel, 23, of the Cameron police — both in Barron County.
We don't yet know details, but perhaps those officers did not fire soon enough.
What follows is an appeal (abridged) from Mark Wagner’s wife:
We live in far-Left Madison WI and the “defund the police” mob whipped up rage, LIED about what happened, and trashed Mark’s reputation.
And now Mark faces 10 YEARS behind bars for doing exactly what he was trained to do in the line of duty … On the morning of February 3, 2022, Mark and other officers tried to arrest … Quadren Wilson. …He was wanted for allegedly dealing fentanyl to a man found dead in a restaurant bathroom.
Mark’s arrest team planned to capture Wilson in his vehicle using a containment strategy. They pulled in their trucks to block his car on both ends. But Wilson floored the accelerator, spinning his wheels wildly in a desperate attempt to escape justice. Mark and another officer exited their vehicle to make the arrest. Mark was holding one of those big POLICE shields and had his gun drawn.
But Wilson refused Mark’s commands to show his hands, continuing to spin his wheels and try to force his way out. With the wheels screeching and smoking, Mark and the other officer saw Wilson reach into the center console and pull his hand up. Mark thought Wilson had a gun. He heard what he thought was gunfire. Then Mark felt something hit the shield he was holding and push him backward.
Both Mark and the other officer responded to this life-threatening situation by firing into the vehicle. Mark believed his life and his fellow officers’ lives were in danger. … Thankfully, Wilson survived and no one else was injured. But because Wilson is black and Mark is white, anti-police radicals jumped at the chance to target Mark.
Protesters drummed up a racial firestorm by spreading lies that Wilson “had his hands up” and that he “was shot five times in the back.” The corrupt liberal media repeated these lies and painted my husband as a monster. … The liberal district attorney caved to the mob and filed BOGUS felony charges against Mark. …
Our hope that justice would prevail was quickly fading when we received a call from the Law Enforcement Legal Defense Fund (LELDF) offering to help Mark. This incredible organization helps innocent officers, like my husband, who have been unfairly prosecuted for split-second, use-of-force decisions in the line of duty. …
LELDF doesn’t receive any money from the government to help police officers facing unjust charges. … Will you help by making a tax-deductible donation?
No trial date has been set. A status conference is scheduled 06-13-23.

In my opinion; if this account is factually accurate then there is a travesty of justice under way and there should be a be a rapid acquittal. If convicted, the conviction will be thrown out on appeal.
As usual, irrational social justice warriors, and the ignorant fools that support them, have intimidated those in the system so they can get their pound of flesh “justice” because a black man was shot; truth and justice be damned because the ends justifies the means.
No matter what the final outcome of this incident is, as a result of the propaganda campaign against Mark, Mark’s life in this area is done, he’ll have to move his family. As far as I’m concerned law enforcement in this area, as a collective, should help pay for Mark’s relocation and do their best to secure him a new job in his chosen field.

If acquitted it will keep on going just like the Tony Robinson case. I wonder if there is camera footage. Madison mayor and city council doesn’t want police body camera’s because it might tell a different story than what they want.

Our fellow Dane County citizens obviously like the local government we have (see recent Mayoral, Council, and School Board election results). I expect the quest for good government is rapidly concluding hereabouts. Sorry, Wagners, you should have gotten out while the getting was good.

While he could be worse, Ozanne has shown himself to be at best selective in his application of justice, and is more apt to consider which way the political (i.e. social justice) winds are blowing when filing charges. That’s why Althea Bernstein never saw a day of jail time while a cop doing his job per training might.

My research shows that 70% of the time, a Felon In Possession (of firearm) charge is dropped.

I think in Dane County Circuit Court it is more like 99% are dropped. The only ones that seem to be prosecuted are done so in Federal Court. We will see what happens to the shooter at the jail when he goes to trial. He also had a handgun modified( auto sear) to fire fully automatic.

A pity Wisconsin doesn’t have a governor like the one in Texas who is trying his best to pardon a victim of BLM fanaticism (with a little prodding from Tucker Carlson, bless his heart). Instead, the miserable old scarecrow in the governor’s mansion is pardoning criminals left and right, hoping of course that they vote a straight Democrat ticket in 2024.
