Four college white boys never threw a lighter, much less did anyone matching that description walk up State Street with a bottle of charcoal lighter fluid as alleged by the would-be social justice martyr, now revealed to be a hoaxster. Althea Bernstein must have cost taxpayers hundreds of thousands of dollars on a wild goose chase — on a story that was never plausible except to those — like Mayor Satya, The Capital Times, and other progressives — who wanted to believe the worst about Madison WI.

That this scam was reported in the vicinity and on the same 06-24-2020 night that BLM tried to torch the City-County Building and pulled down historic statues is yet another insult to a civil, ordered society. The Werkes reported early and often that all of downtown Madison outdoors is on 24/7 video camera. We reported early and often that police could find no visual corroboration, no witnesses, and no lighter.

In other words, the story stank from the get-go!

Feds say it never happened

After a thorough investigation into the events of June 24, 2020, including extensive interviews, exhaustive review of traffic and surveillance video, and expert review of digital and forensic evidence, federal investigators determined that there is insufficient evidence to prove that a violation of any federal criminal statute occurred. Further, after reviewing all available evidence, authorities could not establish that the attack, as alleged by the complainant, had occurred.  — U.S. Attorney Scott Blader

Statement from acting Police Chief Vic Wahl:

The Madison Police Department is closing the investigation into this case. After an exhaustive probe, detectives were unable to corroborate or locate evidence consistent with what was reported.

Althea Bernstein’s car captured, date and time-stamped at intersection of State and Gorham Sts. where Althea said it all went down. Do you see four white frat boys? Flames? She’s not even stopping!


The Madison Police Department dedicated significant resources to this case. The investigation was led by the MPD Violent Crime Unit, with support from the Forensic Services Unit and Central District. Detectives conducted numerous interviews, reviewed extensive video, and analyzed physical/digital evidence during the course of the investigation. MPD was assisted in these efforts by the Federal Bureau of Investigation (FBI) and the Wisconsin Division of Criminal Investigation (DCI).

Consistent with MPD’s Core Values, Code of Conduct, and Standard Operating Procedures, the victim was treated with dignity and respect at all times during the course of this investigation. MPD, FBI and DCI personnel had regular contact with the victim and family, who were cooperative with investigators. The Madison Police Department is committed to thoroughly investigating alleged hate crimes and holding offenders accountable.

Case findings were also reviewed by the United States Attorney’s Office for the Western District of Wisconsin and the United States Department of Justice Civil Rights Division. Both independently evaluated the facts and reached the same conclusion as MPD.

Blaska’s Bottom Line: Althea Bernstein won’t be prosecuted because, unlike Jussie Smollett, no Ethiopian brothers will come forward to say they were paid to scam the public. But Madison’s woke insomniac Left ought to ponder why so many social justice warriors feel they must concoct hate crimes.  And why they — and the major news media — were such willing dupes to believe this girl’s fantastic (as in fantasy) tale.

Will BLM/Antifa cry ‘racist cover-up?’

    Anyone with a brain new what this was from the start. Out of respect for due process (something the left doesn’t understand) and the slight chance we were wrong, we remained quiet.

    As frustrated as I am by the lack of charges for this HATE CRIME, I understand the position the police are in here. It has been obvious from the beginning that Althea, despite her façade of being a “strong, successful woman of color,” was actually an immature, 18 year old trying to cover the fact that she was where she wasn’t supposed to be that night. She was out on a date don’t you know, and NOT trying to firebomb the CCB. So she decided to lie about and lay a smack on those classic Wisconsin frat boys that she so despises, in the process.

    Once she said it, there was no turning back. I was sort of sympathetic to her predicament, until she spoke to a crowd of protesters and told the story again, remarking how “empowering” that made her feel. She should be going to jail, and she isn’t. But she will be paying a price and we all have Chris Rickert to that for that. His coverage exposed her ridiculous story for the blatant lie that it was. I think it was telling that Mayor Satya felt the need to “brief community leaders” on the police dropping the case, before it was announced publicly. Would have been sort of embarrassing if BLM and Freedom Inc had a protest over not prosecuting a hoax. But Althea will not avoid a cost for this. She will forever be known in this community for the fraud that she is. If she chooses to just live with her lie, and pretend that people don’t know, I predict psychological issues and a relocation in her future. Not jail, but it will have to do.

        Not even close, The price she paid is her credibility, from now until she confesses the truth. I predict a relocation in her near future. Her name will be right up there with Audrey Seiler in Madison folklore, forever.

    It is noteworthy that very few national media sources have picked up this story. Good Morning America has not posted about the story. My guess is that they are too embarrassed.
