Memo to the chronically offended. Your day in court is almost over.

Large diverseHooray for the Supreme Court. On Thursday (06-20-19) seven of the nine justices (including liberals Breyer and Kagan) allowed a WW1 memorial in the shape of a Christian cross to remain standing in Maryland where it has stood since 1925.

In a lesson that should resonate in Madison (Confederate Rest, anyone?). Justice Alito wrote: 

“As our society becomes more and more religiously diverse, a community may preserve such monuments, symbols, and practices for the sake of their historical significance or their place in a common cultural heritage.” 

What’s more, taking down such symbols may be even more “evocative, disturbing, and divisive” than leaving them stand.

In a minority concurrence, Justice Gorsuch went beyond historicity, The Wall Street Journal reported: 

“What matters when it comes to assessing a monument, symbol, or practice isn’t its age but its compliance with ageless principles,” he wrote in his concurrence. “The Constitution’s meaning is fixed, not some good-for-this-day-only coupon, and a practice consistent with our nation’s traditions is just as permissible whether undertaken today or 94 years ago.”

This “will bring with it the welcome side effect of rescuing the federal judiciary from the sordid business of having to pass aesthetic judgment, one by one, on every public display in this country for its perceived capacity to give offense,” Justice Gorsuch wrote. “In a large and diverse country, offense can be easily found.”

Round ’em up, bring ’em back!

Imagine if Scott Walker had done this:

“Oregon governor sends police to find missing Republicans,
bring them to Capitol.”

That’s the headline in a Portland newspaper this week.

All 11 Republican senators are in hiding, at least some of them out of state, in order to prevent the Senate from having the quorum it needs to operate. They can’t abide the Democrat-backed carbon cap and spend bill that is up for a Senate vote today.

Ann of Althouse recalls the 13 Wisconsin Democrats flee bagging Act 10: “With the Republicans absconding, in Oregon, the fleebaggers are automatically bad and the Democrats — ready to legislate and deprived of the quorum — are the easy good guys.”

But wait, there’s more!

A little civics — The Wisconsin Supreme Court by a partisan 4-3 vote this morning (06-21-19) upheld limits Republicans enacted during the so-called “lame duck session” on the powers of the newly elected Democratic governor and attorney general.

Even Democrats should know that legislators and governors serve until their successors are sworn in; their terms do not end on election day. 

A little sauce for the goose — Dan Bice of the Milwaukee Journal Sentinel issues this plea:

I’ve written up numerous pols for being delinquent on taxes. I wrote up GOP Supervisor Dan Sebring a month ago. No liberals complained. Liberals even turned my stories on Kim Simac’s tax issues into a TV ad. So why are Dems complaining about my coverage of Lt. Gov. Mandela Barnes? Is it OK for me to ding conservatives on delinquent taxes but not liberals? 

A little justice — National Review reports that a Chicago judge appointed a special prosecutor on Friday to investigate Cook County state attorney Kim Foxx’s handling of the investigation into Jussie Smollett’s alleged hoax hate crime.

A little history — MSNBC’s Kasie Hunt identified segregationist senators from Joe Biden’s “civility” boast as Republicans. James Eastland of Mississippi and Herman Talmadge of Georgia were actually Democrats. 

A little learnin’ — A Polish official has invited Ocasio-Cortez to Poland to see an actual concentration camp. More here.

      Such erudition and eloquence on display in Judge Gorsuch’s remarks! Let’s hope that President Trump–either in this term or the next–appoints more justices like him. He demonstrates brilliantly how respect for tradition and the principles of the Constitution ought to drive the Supreme Court’s decisions rather than an automatic capitulation to the demands of the perpetually aggrieved.

      The “traitors” in question were POWs who died under deplorable conditions in what today would be called a concentration camp. Too bad Madison didn’t offer them an opportunity for restorative justice.

    Richard, someone new to this blog might be concerned for you, RE: the resounding THUMPS that the Gotch gives ya. But we must applaud his efforts. You never offer details with your terse yet consistently negative responses, nor any real insight as to your opinions. Would that life be that easy. Since it is NOT, how’s about a tad bit of substance & a cognizant reply based on the world that surrounds us. This Blaska post was comprehensive w/ multiple subjects. I notice their absence in your comment. They were: Flee-baggin’, (OK when Dems do so), Smollet’s un-surprising new turn-of-events, and AOC’s obvious ignorance of not only WW2, but of places and facts easily researched. Do you seriously expect anyone to take you seriously? Likewise: A-Bob, Jeff & Bobby Dee?

        Speaking of fishing, I post this as I look out over a breathtakingly beautiful Iron County inland lake, evoking treasured childhood memories of those moving Hamm’s Beer ads behind a Northern Wisconsin bar as one sees/hears/smells their burger being grilled.
